TERMS OF SERVICES
By choosing to commission me, you acknowledge that you have read and understood my Terms of Service, and thereby agree to abide by the following rules.
- Any and all of the artist's artwork are NOT to be used with or for AI (generative or not), NFT, or any related intents and purposes.- By default, the client only acquires the right for PERSONAL use of the commissioned piece(s). Other uses of said pieces, including but not limited to their alteration, reproduction, distribution, or sale, by any party are prohibited unless discussed with the artist either in advance or post-production.- Prices on the COMMISSION page only refer to personal usage. For commercial usage or others please discuss with the artist.- Please give credit to the artist on social networks for any and all work, either by tagging the artist's username/handle or leaving a link to the artist's profile. A watermark will also be applied on any and all commissioned pieces unless discussed otherwise.- The artist retains any and all creative ownership and copyright ownership of any and all works produced through the commission process unless discussed otherwise.- The artist retains all commercial rights to any and all works produced through the commission process, including but not limited to: marketing, sale of digital products, sale of physical products such as prints, or any other merchandise.- The artist reserves the right to showcase the process or any stage of the commissioned piece(s) on social networks, streaming websites, and portfolio pages. If the client wishes to privatise or postpone the publication of said process and/or images to a later date, please discuss the NDA with the artist in advance. Additional fees might be incurred for such requests.- Commissioned work under NDA will not be publicised until the agreed-upon date OR when the client publicises said pieces first, whichever date comes before.- The artist may turn down any project or client for any reason.- The artist has the right to terminate work and void the commission if the client (1) violates any rules laid out in the TOS, (2) behaves in a manner deemed as harassment or hostility by the artist, (3) cannot or refuse to communicate in a productive manner.- Once a commission request is confirmed, work on the piece begins once it has been paid in full. All payments must be made within 1 week of confirmation, unless discussed otherwise. If payments are not made according to the agreed-upon schedule, the artists reserves the right to cancel or reschedule the commission request.- The time needed for each commission will vary depending on the complexity and the artist's current work queue. The deadline(s) for a commission needs to be discussed and agreed upon before work on the piece(s) has started.- All payments are to be made in USD and through either Wise or PayPal, directly from the client. Payments from third parties are not accepted unless discussed beforehand.- Prices on the COMMISSION page only serve as guidelines and are subjected to change according to the commission. Extra complexity or extra requests might incur additional fees.- NO REFUNDS will be offered unless the artist fails to either (1) complete the artwork within one month after the agreed deadline or (2) make any progress on the commission in 6 months (from the date of previous progress). If the client cancels the commission at any stage, NO REFUNDS will be offered.- Once a full refund is made, the client forfeits any and all rights related to the artwork and its production process. Partial refunds can be discussed and the commission may be delivered in its current stage.- The client must communicate any payment error as soon as possible.- Revisions may be made once before the draft is approved and the work moves into its rendering stages.- Progress updates will be given up to two times a week, depending on the deadline and the artist's work load. Commissions with extra tight deadlines (<=10 days) may or may not be updated on more regularly.- All deliveries will be done through digital means, either social networks or email. High-resolution files are to be shared at time of completion.
